1. Parties - Cut Price Racing (which may be referred to as CPR or CPR
 Kart Parts in this document) (the ‘supplier’) will supply ‘the customer’ the goods or services set out in any invoice provided to the customer from time to time (the ‘goods’/’services’).


2. Supply - Goods will be supplied in the quantity and at the price as specified in the invoice provided to the customer upon completion of the checkout.

2a) Phone Orders - clients accept that due to the nature of placing orders over the phone, CPR shall not be liable for any goods that are supplied differently than the customer interpreted the communication.


3. Payment - Goods and/or Services are purchased by the Customer subject to the following:

3a) Payment is to be made within 7 days of the date of checkout completion.

3b) Terms and conditions of payment for the goods and/or services are strictly Cash (or Credit Card). This cash may be provided by either Bank Transfer, Paypal (Cash or Credit Card), Money Order.

3c) any special/additional rates of carriage incurred as a result of special or extraordinary carriage being requested by the customer, shall be paid by the customer.


4. Postage/Courier – Goods are sent or carried subject to the following:

4a) Goods are carried via a regullar service unless there is an alternative method offered by the supplier and that alternative method is chosen by the customer.

4b) If express shipping is chosen, the express upgrade fee will be added to the subtotal and included within the invoice.

4c) If express shipping is chosen, the supplier will choose the fastest method to ship the goods and use that carrier and service for transportation.

4d) Any other carrier may be offered at the discretion of the supplier upon request from the customer with respect to 3c. Should the supplier decide not to send goods via the requested carrier they shall be sent by the methods outlined in 4a-4c.

4e) NON-DELIVERY - if the customer chooses not to accept a delivery, or a carrier chooses to request collection from a depot and the customer chooses not to collect a delivery, or a customer provides incorrect delivery information or contact details which lead to a carrier being unable to effect delivery, then the customer may incur a redilvery fee either by the suppliler or by the carrier.  In the case that the goods are returned to the supplier then the supplier may choose to accept a return under the change-of-mind policy in the returns and refunds policy.

5. Title Transfer - The customer shall not aquire any right title or interest in the Goods until the Customer pays the purchase price of the Goods in full.

6. Defaulted Payment - The customer will be liable to the supplier for all and any loss or damage to any goods which the supplier retains the title and which are in the customer’s possession custody or control and whether or not caused by any act or omission of the customer.

7. Liability - All parts supplied are intended for use with race-style go karts only.  In no event shall the supplier be liable for any special, incidental, indirect or consequential damages including damages for injuries or breakages as a result of the use of the goods by the customer and without limitation the supplier shall not bear any liability for any loss or damage to the goods or non-delivery, delay in delivery, concealed damage, deterioration, contamination or evaporation of goods held in the suppliers care, custody, or control or any consequential loss however caused apart from loss caused or occasioned by criminal acts of the supplier.

8. Warranty on engines and engine parts - All enigne parts and engines are intended for racing purposes.  Items faulty straight out of the box (unsused and not-fitted) will be processed under the "Items faulty straight out of the box" return policy on our returns policy page. CPR makes no other warranties, expressed or implied, including any implied warranties of merchantability or fitness, with respect to such goods.  All CPR Engines are intended for use on race tracks in Australia.

9. Warranty on Not-Brand-New items (Used, Shop Soiled, Display Stock, Damaged items or other types of Not-Brand-New). These items are sold "AS IS" and with all faults. CPR makes no warranties, expressed or implied, including any implied warranties of merchantability or fitness, with respect to such goods.  Iif the item does not specify "Brand New" as the condition of the item it is subject to this type of warranty unless a DOA clause has been added within the description of the goods. If a DOA warranty is described within the listing description of the goods, this means if the item does not work upon receipt then CPR will repair or replace the item or provide a partial refund if this is brought to the attention of CPR in writing (by email) within 30 days of receipt of the goods.  Receipt of the goods will apply from the date that the goods are delivered to the client or the client's agent if applicable.
